Does any one know the rules of right to first refuse in child custody cases?
The judge just added the right to first refuse to my parenting plan. This is not a problem for me because I am always home with my children and only work every other weekend, the days my ex has the kids. I am wondering about short notice. I work nights and in emergency situations at the hospital I may go in for a few hours while the children are sleeping. My husband, the children’s stepfather and father of our 2 children together stays with the kids. They don’t even know I am gone, do I still have to call him? And yes there is a great lack of communication between my ex and I. I call, he doesn’t return the calls. I e-mail, he doesn’t return the e-mails. I am lost on how to co-parent with this man. Mediation is begining soon.
mediation will help but until then how it works is that BEFORE you go out and HIRE(PAY) a babysitter or nanny money you must first call your ex(their father) and ask him if he can help you out by watching the kids. NOW right of first refusal only really applies if you have to pay someone. but since you have your husband (stepdad) it;s no problem.
you are alright. You have to coparent in a fair way with the childrens best interest at heaart. NO STRINGS ATTACHED and if you approach it that way then you should be ok.
Just as an example. if he(ex) says he has to switch a weekend with kids to work, say ok and switch because it;s something he needs or if the kids want an extra day at dads because he is doing something special then say ok because the children still need their dad. If you are going to be late call him as a courtesy because he shouldn’t have to wait to pick up his kids and vice versa. If he (ex) is sick offer to either switch weekends or drop the kids off to him.
Basically show kindness and it should be returned. respect bothways and cooperation by BOTH (him included) will go a long way to making this situation a better one for you and the kids(most importantly)
