parenting an 18 year old
wat will happen if an 18 year old has sex with a 16 year old but the 16 year old turns 17 in a couple weeks?
the parents want to send the 18 year old to jail but the 16 year old was totaly willing and she does not want him to go to jail.
The parents can’t ‘send him to jail’, however, they can press charges, as it is illegal for an adult (18 year old) to have sex with a minor (under 18). The judge will be the one to decide. If the 16/17 year old goes before the court and says she was willing, etc. he may get off or get a lighter sentence, but they don’t look at it being physically forceable sex, but emotionally forceable, in the sense that the person who is under 18 is not emotionally able to make the decision to have sex and the court believes that someone who is an adult and is over 18 may have a higher maturity level than you and may be able to use that to their advantage. This is the way it is in some instances and the court has put these rules in place to protect those that are underage. Of course there are some situations where this is not the case – so the court looks into it on a case by case basis, but don’t expect he’ll get out of much – the law is the law.
